Active Tribe Courtown Terms & Conditions

These Terms and Conditions relate to all facilities owned and activities/services operated and provided by Active Tribe Ltd. (T/A Active Tribe Courtown) at Courtown Harbour, Gorey, Co. Wexford, Y25PD92

Upon making a booking, becoming a member or entering Active Tribe Courtown, a customer accepts and agrees to be bound by these terms and conditions. A customer also agrees to have read and understand the risks associated with using the facilities or undertaking activities and agrees to our legal waiver.  We expect all of our customers and staff to adhere to our Codes of Conduct. Our Safeguarding Statement is available here.

Management reserve the right to refuse admission at all times.

Admissions Policy - Gym, Fitness Classes

Booking required. Access to the Gym including free weights is for those aged 18 years and over. Children aged 16 years and over can access the cardio machines in the gym only

Booking required. Access to Fitness Classes is for those aged over 16 years.

Admissions Policy - Swimming, Pools

Booking required. Children under 8s must be accompanied by an adult (over 18) at all times. Children aged 8 to 11 years old must be supervised by an adult. The facility is only open to adults after 8:00pm

Refund Policy

A refund, reschedule or credit for non-use of membership, booked activity/facility or class (including swimming class) will not be granted under any circumstances. In circumstances where a customer has been advised to cease fitness activity or isolate by a medical professional we can review a request for refund if it is accompanied by a medical note or evidence of instruction to self-isolate. Any request for a medical refund can be made to the manager via email to hello@activetribe.ie

Booking Cancellation Policy

Guests can cancel online bookings by logging in using the email address they used in their bookings: www.activetribe.ie/member. The unused products resulting from the cancelled bookings can then be used by the customer in a future booking via the member's portal. No refund is offered for cancelled bookings or unused products

Returns Policy

Any product bought at Active Tribe Courtown that is faulty should be returned to the centre with a the receipt or alternative proof of purchase. Swimwear and related accessories cannot be returned for hygiene/safety reasons so please ensure you select the correct size clothing or accessory prior to purchase.

Purchases for bookings, courses, lessons, classes etc. are non-refundable, nor is a refund available in cases where a customer ‘changes their mind’ regarding the purchase of a product or service. In all aspects regarding refunds, Centre Management’s decision is final

Infectious Medical Conditions

Customers agree not to visit Active Tribe Courtown if suffering from an infectious or contagious medical condition or has symptoms of such conditions. We reserve the right in our discretion to refuse entry to a customer who appears to have an infectious or contagious medical condition

General Fitness Screening

If you answer yes to any of the following we strongly advise you to book a fitness assessment prior to training at Active Tribe Courtown:

  • history or family history of heart disease
  • high blood pressure or medicated for the same
  • smoking habit
  • diabetes/Mellitus
  • high cholesterol
  • asthma/respiratory disease
  • recent surgery
  • chronic disease
  • pregnancy within the last 3 months
  • back, joint or muscle disorder
  • incidents of seizure, blackout or fainting
  • taking any medication or substance
  • more than 20lbs overweight
  • exercise has been recommended to you by a medical professional

Customers are required to accept responsibility for their personal, medical and physical condition in order to take part in Active Tribe Courtown activities including the use of the gym and gym equipment, swimming, sauna and steam rooms. Any assessment undertaken in the facility is for general information only with a view to giving advice and should not be relied on by customers as certifying their fitness or otherwise to the facilities or equipment.

Active Tribe Courtown advises all customers to consult with their doctor or medical professional prior to beginning a programme of physical exercise

Fitness Classes

All group fitness classes listed in the group fitness timetables can be viewed under the member’s portal. “Swim, Gym and Classes” membership includes the cost of all fitness classes and will allow you to book classes in advance. The cost of swimming lessons, outdoor camps and courses are not included in any membership and must be booked and paid for separately and in advance within the appropriate member portal. Classes are available for persons aged over 16 years only unless otherwise stated. 24 hours’ notice is required to cancel a class booking. Active Tribe Courtown reserves the right to withdraw booking privileges if you fail to give the required notice to cancel a class. Classes are subject to change at any stage.

Swimming Pool Use

Active Tribe Courtown recommends all swim slots be booked in advance of arrival. Swim slots can be booked and paid for on a pay as you go basis at Reception, from our website and booked free of charge by members through the membership portal. Active Tribe Courtown reserves the right to limit access to certain areas without notice and a swim booking does not guarantee use of all areas at all times

For operational reasons, some other facilities may not be available for you to use as part of your booking (such as water slide/flume, Learner Pool, Toddler Pool, part(s)/lanes of the Main Pool, Sauna, Jacuzzi/Spa Pool, Steam Room, Ice Bath, parts of the Changing Village or shower facilities). No refund or credit will be offered should any such facility not be available for use.

Pool Use Rules

  1. Swim hats must be worn in the pool at all times by pool users aged 3 years or older. Swim hats are available for purchase at Reception
  2. All children who are not toilet trained must wear a swim nappy when they are in the pool. Disposable swim nappies in various sizes are available for purchase at Reception
  3. All children under 8 must be accompanied by an adult at all times. This includes when the children are not in the Learner Pool
  4. Please shower before entering the pools and after using the Health Spa
  5. Appropriate swim wear must be worn at all times
  6. Running, jumping and acrobatics are strictly prohibited in the pool area
  7. Instructions from lifeguards and all other staff must be followed at all times
  8. Snorkels, flippers and glass masks are not permitted
  9. Outdoor footwear is not permitted on pool side
  10. Swimmers are encouraged to wear clean pool flip flops/jandals/thongs/sandals on the pool deck
  11. Food or drink is not permitted in any of the activity, pool or changing areas of the facility. Chewing gum and glass containers are strictly prohibited on site
  12. Personal items must be stored in the lockers provided in the Changing Village and require a padlock to secure your belongings. Active Tribe Courtown always recommends securing your belongings in a locked locker and take no responsibility for customers' personal property at any time
  13. Balls and other inflatables and toys are permitted in the pool but if they cause discomfort for other users they must be removed
  14. When swimming in the lanes please follow correct lane etiquette
  15. Those under 18 years old are not permitted in the Health Spa
  16. A minimum of height restriction of 1.2m applies when using the Flume Water Slide
  17. All swim sessions start on the hour or half past the hour
  18. The pool timetable is subject to change at any time as directed by centre management
  19. The building will close half an hour after the final whistle has blown
  20. Access to storage rooms is strictly prohibited
  21. Management reserves the right at any time to vary these rules and the Centre timetable
  22. The use of video recording equipment or devices is prohibited within the leisure centre building. Locations include, but are not limited to: the Gym, Changing Village, Toilets, Pool Side, Health Spa, Studios
  23. Active Tribe Courtown reserve the right to remove participants of any age from any activity due to unacceptable behaviour

Sauna, Steam Room Health Spa Rules

  1. The Health Spa is an adult only area. Those under the age of 18 are not permitted in the Health Spa. Please read the user guidelines for each facility before use
  2. For health and safety reasons it is advised guests with known medical issues such as, but not limited to, heart conditions, high/low blood pressure, diabetes, respiratory conditions or are pregnant seek the advice of a medical professional before using the Health Spa facilities
  3. Observe a sensible time limit of 5-15 minutes in the Health Spa
  4. The Spa Pool is controlled by an automatic timer and should be vacated when the bubble period ends
  5. Shower between each heat exposure and before returning to the pool(s)
  6. Appropriate swim wear must be worn at all times
  7. It is recommended to remove all jewellery before using the Health Spa facilities
  8. A heat/cold cycle can be repeated as often as comfortable. However, extended use of the Health Spa facilities way result in nausea, dizziness or fainting. If you feel any of these symptoms please alert a member of staff immediately
  9. Shaving and the use of creams, oils and lotions is not permitted in the Health Spa
  10. The use of shampoo and shower gels is not permitted in the Health Spa
  11. Food or drink is not permitted in any of the activity, pool or changing areas of the facility. Chewing gum and glass containers are strictly prohibited anywhere on the site
  12. The use of mobile phones, cameras or any other recording equipment is strictly prohibited throughout the centre
  13. The Sauna, Steam Room and Health Spa are not available during Children's Swim Academy
  14. The use of video recording equipment or devices is prohibited within the leisure centre building. Locations include, but are not limited to: the Gym, Changing Village, Toilets, Pool Side, Health Spa, Studios
  15. Active Tribe Courtown reserve the right to remove participants of any age from any activity due to unacceptable behaviour

Gym Rules

  1. For health and safety reasons it is advised guests with known medical issues such as, but not limited to, heart conditions, high/low blood pressure, diabetes, respiratory conditions or are pregnant seek the advice of a medical professional before using the Gym
  2. There are no lockers in the Gym. Personal items must be stored in the lockers provided in the Changing Village and require a padlock to secure your belongings. Active Tribe Courtown always recommends securing your belongings in a locked locker and take no responsibility for customers' personal property at any time
  3. Chewing gum and glass containers are strictly prohibited anywhere on the site
  4. Children under the age of 16 are not permitted to use the Gym
  5. Children aged 16 and 17 are not permitted to use the free weights and resistance machines
  6. Bring and towel to the Gym and clean/wipe down your equipment after use
  7. Food is not permitted in the Gym. Chewing gum and glass containers are strictly prohibited anywhere on the site
  8. Please return/tidy your equipment after use and report any defects to a member of staff
  9. Appropriate clothing, including footwear, must be worn at all times
  10. The instructions of centre staff must be followed at all times
  11. The use of mobile phones, cameras or any other recording equipment is strictly prohibited throughout the centre
  12. Always use CV and weight machines as directed. If you have any questions regarding exercises, programmes or machinery please contact a member of staff
  13. The use of video recording equipment or devices is prohibited within the leisure centre building. Locations include, but are not limited to: the Gym, Changing Village, Toilets, Pool Side, Health Spa, Studios
  14. Active Tribe Courtown reserve the right to remove participants of any age from any activity due to unacceptable behaviour

Fitness & Spin Studio Rules

  1. Use of, and access to, the Dance Studio is not permitted without an accompanying member of staff
  2. Food or drink is not permitted in any of the activity, pool or changing areas of the facility. Chewing gum and glass containers are strictly prohibited anywhere on the site
  3. The use of mobile phones, cameras or any other recording equipment is strictly prohibited throughout the centre.
  4. For health and safety reasons it is advised guests with known medical issues such as, but not limited to, heart conditions, high/low blood pressure, diabetes, respiratory conditions or are pregnant seek the advice of a medical professional before using the Spin and/or Fitness Studio
  5. Children under the age of 16 are not permitted to take part in Fitness Classes
  6. There are no lockers in the Dance Studio. Personal items must be stored in the lockers provided in the Changing Village and require a padlock to secure your belongings. Active Tribe Courtown always recommends securing your belongings in a locked locker and take no responsibility for customers' personal property at any time
  7. Food is not permitted in the Dance/Fitness Studio. Chewing gum and glass containers are strictly prohibited anywhere on the site
  8. A booking must be made online or at Reception to attend fitness classes/courses
  9. The directions of staff must be followed at all times
  10. Please do not turn on/off, adjust or block the air conditioning equipment
  11. Please clean/wipe down your equipment after use
  12. The use of video recording equipment or devices is prohibited within the leisure centre building. Locations include, but are not limited to: the Gym, Changing Village, Toilets, Pool Side, Health Spa, Studios

Padel

  1. Padel Courts, Lessons, Coaching, 1:1 sessions must be booked in advance online, in-person or by phone by calling 053 94 25354
  2. Padel group bookings/enquiries must be made in advance by contacting Centre Management by calling 053 94 25354 or by email at hello@activetribe.ie
  3. All Padel bookings must check in at Reception
  4. Centre Management reserve the right to reallocate 'no-show' bookings where no contact has been made by the booking person/party 15 minutes after the start of the booking
  5. Padel bookings are for the duration of the booking only. No extension will be provided due to a late start, weather or any other reason
  6. Padel rackets must be used at all times. Balls and other equipment are available to rent/purchase as applicable at Reception and as part of the online booking process.
  7. A Padel booking is final, no refund is available
  8. Rescheduling of a Padel booking may be possible up to 24 hours before a booking and subject to availability. Contact the Centre for further information or to arrange
  9. If a peak Padel booking is rescheduled to an off peak time no refund/credit will be provided
  10. Any Padel privileges/offers/discounts tied to Memberships may be revoked at any time at Centre Management's discretion
  11. Active Tribe Courtown reserve the right to remove participants of any age from any activity due to unacceptable behaviour
  12. Padel competitions/tournaments etc. are arranged and officiated by Centre Management and Staff. The decisions of Centre Staff will be final
  13. Prizes/offers are at the discretion of Centre Management on case-by-case basis with no precedent set in their provision

Outdoor Activities

  1. Use of the centre is subject to Active Tribe Courtown’s full Terms & Conditions at all times. These can be viewed at activetribe.ie/terms
  2. All participating adults must complete an Acknowledgement of Risk Form for themselves and/or for children in their care before activities can begin. This form can be downloaded from activetribe.ie/outdoorwaiver
  3. On the day of the booking a group must nominate a group leader with whom centre staff will liaise
  4. It is the responsibility of participants to ensure that they are adequately dressed for the weather and activities including appropriate outdoor footwear and hair tied back
  5. We will do our utmost to ensure that the whole group completes all activities booked and ask groups to ensure that they arrive on time
  6. Full payment must be received at least 24 hours in advance of the booking. The booking will not go ahead if payment has not been made
  7. Changes to bookings (i.e. number of participants, activities) will not be permitted within 7 days of the booking date
  8. It is the responsibility of the group organiser to ensure that participants meet activity specific minimum height and age requirements and do not exceed maximum weight requirements as appropriate. No concession will be made for those who do not meet activity specific requirements (listed below)
  9. All activities are available on a ‘Trial by Choice’ basis. Instructors will encourage all participants to partake in the activities but it will always be the participants choice to join in. No concession will be made for those who do not complete the activities booked
  10. Instructors must be informed of pre-existing injuries or medical conditions that may be affected by use of the centre’s activities or equipment. It is the responsibility of the group organiser/participant to decide if participation is appropriate. No concession will be made for those who do not complete the activities booked
  11. Personal belongings are the responsibility of their owner at all times. Lockers are available in the Changing Village
  12. Active Tribe Courtown will take no responsibility for personal items lost or damaged and recommend pockets are empty while partaking of activities
  13. Our outdoor activities are designed to operate in all weather conditions. However, where weather warnings are issued by Met Éireann (met.ie) activities may have to be rescheduled. In such cases, no refund will be available
  14. Active Tribe Courtown reserve the right to remove participants of any age from any activity due to unacceptable behaviour
  15. The service purchased entitles access to the booked activities at the specified time(s) and for the number of participants booked. Active Tribe Courtown reserve the right to fill unused spots and/or refuse access to unexpected numbers

Outdoor Activity Camps

  1. Use of the centre is subject to Active Tribe Courtown’s full Terms & Conditions at all times. These can be viewed at activetribe.ie/terms
  2. All participating adults must complete an Acknowledgement of Risk Form for themselves and/or for children in their care before activities can begin. This form can be downloaded from activetribe.ie/outdoorwaiver
  3. It is the responsibility of parents/guardians to ensure that children are adequately dressed for the weather and activities including appropriate outdoor footwear and hair tied back. Participants inappropriately equipped may not be able to partake in activities
  4. All advertised activities are indicative of the activities provided at Active Tribe Courtown. Available activities are dependant on participants' ability, ages, equipment, scheduling, staffing etc. Not all listed activities will be provided on every Camp
  5. All activities are available on a ‘Trial by Choice’ basis. Instructors will encourage all participants to partake in the activities but it will always be the participants choice to join in. No concession will be made for those who do not complete an activity
  6. As per Active Tribe Courtown's Admissions Policy swimming is not available for children under 8 years old as part of any Outdoor Activity Camp
  7. Parents/Guardians must inform Active Tribe Courtown of any additional needs or health conditions pertaining to their children in our care during an Outdoor Activity Camp
  8. Active Tribe Courtown take no responsibility for personal belongings including cash
  9. Active Tribe Courtown reserve the right to remove participants of any age from any activity due to unacceptable behaviour
  10. No refunds are available for Outdoor Activity Camp bookings
  11. Outdoor Activity Camp places are limited and only secured with booking and 100% payment in advance
  12. As with all Active Tribe Courtown terms, the decision of Centre Management is final

Food and Drink

Food or drink is not permitted in/on any of the activities/facilities provided at Active Tribe Courtown. Chewing gum and glass containers are strictly prohibited on the site.

The consumption of alcohol or any other intoxicating substances on site at any time is strictly forbidden. The discovery of such items will result in them being destroyed and/or Gardai being informed

Mobile Phones, Cameras and Recording Equipment

The use of video recording equipment or devices is prohibited within the leisure centre building. Locations include, but are not limited to: the Gym, Changing Village, Toilets, Pool Side, Health Spa, Studios

Please respect other customers’ right to privacy and to use the facilities without being recorded or photographed

Personal Information, Data Processing
In order for the Centre to manage admissions, purchases, identification, contact tracing etc. customers are required to provide limited personal data; this may include name, contact number, email address, date of birth etc. (list is not exhaustive). Any data provided is handled in line with Active Tribe Courtown's Privacy Policies

Lockers
Lockers must be used by all customers to secure belongings. The customer acknowledges that the facility will not be responsible for the loss of any personal items or damage to personal property, either in the facility or in the facility car parking areas. Most lockers require a padlock to secure belongings. Padlocks are available to purchase at Reception

Personal Liability

The customer acknowledges that the facility accepts no liability whatsoever for any personal injury or damage sustained by the customer while they are on site, using the facility, partaking of activities or in the parking areas

Repairs
Facility management will use its best endeavours to ensure that all facilities, apparatus and equipment are maintained in working order at all times but accepts no responsibility to the customer for failure, breakdown of or inability to use any equipment or apparatus howsoever caused

Membership Conditions

Memberships are designed to give you, the customer, the opportunity to pay for use of Active Tribe Courtown facilities by use of a recurring or upfront payment. There are a number of categories of memberships which give you benefits as follows:

  • Adult Membership

Various recurring monthly and annual membership packages are available on www.activetribe.ie

  • Child Membership

To qualify for child membership you must be aged between 3 and 17. Child memberships are only available when linked to an adult membership. Children are restricted from certain activities and areas as outlined in these Terms and Conditions. All children under 8 must be accompanied by an adult in the water unless the child is participating in a swimming lesson.

Membership Verification, Photographs

All memberships require a member photograph. This photograph is used solely to verify the identity of the member and ensure that the membership is being used by the registered member. Members may be asked to have their photograph taken when joining or renewing their membership. Memberships are non-transferable and must not be shared with or used by another person.

Freezing Your Membership

You have the option to freeze your membership at Reception for a minimum of 1 month and up to 2 months per 12 month period for €20 per freeze.  Periods of non-use of the facilities cannot be backdated under any circumstances.

A freeze may be made free of charge due to medical reasons or injury. In such circumstances evidence from a medical professional will be required. Centre Management reserve the right to refuse a to freeze a membership contract free of charge where it deems insufficient evidence has been provided. Management's decision will be final.

Recurring Payments

Payments on the monthly recurring payment option are due regardless of usage. This contract automatically renews on a month-to-month basis after the minimum period.  You will not be eligible to use the facility if your account is in debt. We reserve the right to cancel your membership if payment has not been received within 14 days of the due date.  Customers with cancelled membership accounts will not be eligible for a refund or to retain any paid joining fees. Some of our membership packages may have joining fees. New members or previous members with cancelled accounts may be required to pay a joining fee (where applicable to the membership package) when signing up for a membership account.

Transfer of Membership

Membership may not be transferred or assigned to another person. Membership deposits and fees are not refundable under any circumstances.

Termination of Membership

Management reserves the right to terminate any membership for violation of any rules or regulations of the club or for conduct deemed by the management to be detrimental to the welfare, good order or character of the facility or its members and users without refund.

Membership Cancellation Policy

Members are able to cancel their membership outside of any minimum membership duration period by emailing the Centre at hello@activetribe.ie. Emails must be received at least 48 hours before a contract payment is due for payment. Under the exclusion of contracts for Leisure Activities in the Consumer Rights Act 2022, Part 5, Chapter 5, Section 111, Consumers do not have the right to refund from cancellation of their contract. No full or partial refund will be given for unused periods of membership or joining fee (where paid). A minimum of 4 hours’ notice to cancel a fitness class booking is required. Class booking can be self-managed through the online membership portal.

Health Screening

The member acknowledges that they are in good health and is not suffering from any illness or disease. The facility health screening status questionnaire must be completed and signed by all members in advance of using the facility

Membership Card

Your membership card permits you to enter to the facility to the areas assigned to your membership type. Under no circumstance may you permit any other person to use your card to gain entrance to the facility. Abuse of membership cards will result in membership termination without refund. Lost cards are replaced at a cost of €5 per card.

Membership Gift(s)

Any membership gift(s) are subject to availability on a first-come-first-served basis and may be covered by offer specific terms & conditions. No refund/replacement is available for any item provided as a membership gift under any circumstances. The offering of membership gifts sets no precent for future offering

Disputes
In the event of any dispute arising between a customer of the facility and the management of the facility, the decision of the management will be final. The management reserve the right, in its absolute discretion, to refuse entry and remove from Active Tribe Courtown without refund any person:

  • Not complying with these terms and conditions
  • Deemed to be behaving in a manner which, in the opinion of any Active Tribe Courtown employee has affected or is likely to affect the safety or enjoyment of, or cause annoyance, danger or distress to other customers or damage to property
  • Who uses threatening, intimidating, abusive or insulting words or behaviour or in any way provokes
    or behaves in a manner which may provoke a breach of the peace
  • Appears, in the opinion of an Active Tribe Courtown employee, to be under the influence of alcohol or other substances
  • Fails to comply with the instructions of staff
  • Damages property
  • Who, for any other reason, at the sole discretion of Active Tribe Courtown employees, is deemed to be necessary of removal from the site
  • Any customers or staff that do not adhere to our Codes of Conduct

Amendments
The management reserves the right to amend and add to these conditions or rules as it sees fit and the customer shall observe any amended or additional conditions or rules so made

Jurisdiction
These Terms & Conditions, all disputes and issues between the Operating Company and you arising out of or in any way relating to these Terms & Conditions shall be governed by and construed in accordance with the laws of Ireland

Precedents

Any previous provision of a service/facility/activity/prize/offering/gift/price etc. in line with or, as an exception to, our Terms and Conditions should and will not be regarded as establishing a precedent or creating an entitlement to the same in the future. Our Terms and Conditions remain applicable in all cases unless expressly agreed otherwise in writing.

January 2026 Membership Offer(s)

"Join before the end of January 2026 to lock in last year's prices" applies to new contracts/members only. Retention of 'legacy' priced membership contracts dependant on maintaining active contract and timely payments.

Offer(s) available to current members with purchase of new contract, starting immateriality.
